These Terms and Conditions of Sale are supplementary to our Terms of Use and constitute a legally binding agreement between you and EdenLov ("Edenlov", "we", "us"). They govern online transactions for products or pre-orders (collectively "Orders") initiated or completed on edenlov.com (the "Website"). By using the Website and placing Orders, you acknowledge and agree to these Terms and Conditions of Sale. These Terms and Conditions of Sale may be changed at any time, at our sole discretion, without prior written notice. The most recent version of these Terms of Sale will be published on this Website and you should review them before placing any orders through this Website. Your continued use of this Website after changes to these terms and conditions have been published will indicate your acceptance and agreement to those changes. When a change is made, we will update the 'Last updated' date at the top of this page.
These Terms and Conditions of Sale are an essential part of the Terms of Use that govern your use of our Website. Before placing an order on the Webite, you should also carefully read our Privacy Policy. Placing an order on the Website constitutes an offer to be bound by these Terms and Conditions in respect of that order.
2. Acceptance and Billing
We may request additional information from you before accepting any order and we reserve the right to refuse or cancel any order after acceptance. By confirming your purchase during the checkout process, you agree to pay for the order. To place an order, you must be at least the age of majority in your country of residence (18 years old in most states).
3. Prices and Taxes
All prices are quoted in Euros (€) and include all taxes, except for shipping and packaging costs. Please note that the prices displayed on this Website are subject to change without prior notice. The price charged for a product or service will be the price in effect at the time the order is placed. We are not responsible for pricing, typographical or other errors in any offer made by us. We reserve the right to cancel any orders resulting from such errors.
4. Payment methods
We accept the payment methods provided during the checkout process. We are not responsible for the practices of external payment processors or their terms and conditions. By placing an order, you represent and warrant that the payment information you provide to us is accurate, and that you are duly authorized to use the specified payment method. You also authorize us or our payment processor to charge your specified payment method. Your order may be automatically suspended or cancelled if we are unable to verify your payment method or if it is invalid or otherwise unacceptable. Only payment methods specified by us as valid may be used.
5. Discount Codes
When using a coupon or promotional code, only one can be applied to your order at a time. Once the code has been applied, your order subtotal will be adjusted. If it is a shipping promotion, the shipping costs will be adjusted as long as the correct shipping method is selected. Please review the promotion details to verify that your order is eligible for the promotion.
6. Shipping
A. Edenlov ships worldwide.
All deliveries are subject to order acceptance and product availability. You can track shipments and deliveries by checking the emails we send you, including your spam folder, and by checking the status of your order in the "My Orders" section of our Website. To process your order, we may ask for more information through email or other contact forms. All items bought on the Website are shipped according to a shipping contract. This implies that the risk of loss and title to such items are transferred to you upon delivery to the carrier.
B. Shipping and Delivery times.
We ship orders Monday to Friday, excluding public holidays. To have the option of same-day shipping, orders must be placed before 3:00 p.m. If there is a delay, we will notify you. Please do not confuse shipping times with delivery times. All items are shipped from France. Once the Order has been shipped, the speed of delivery depends on the chosen shipping method. Generally, with Colissimo, in 48 hours to mainland France, from 48 hours to one week to Europe and from one to 3 weeks to the rest of the world. Please note that these are estimated delivery times and Edenlov cannot be held responsible for any delays due to postal service strikes or other unforeseen circumstances provided for by legislation on the transport of merchandise.
C. Shipping costs.
Shipping costs are calculated based on the size and weight of the items. Although delivery prices may vary from one item to another, we always strive to offer you a delivery rate at cost price.
D. International delivery.
Colissimo International Service is responsible for delivering international orders. Please note that we cannot be held responsible for any delays caused by customs. All prices are listed in Euros (€), which may result in additional charges from your bank due to currency conversion.
If you are ordering an item from a country outside the European Union, it is your responsibility to ensure that the item is not subject to any special regulations or prohibited in the recipient country. Unfortunately, we are unable to provide information on the legal status of our products in your country due to the large number of countries we ship to. We are not liable if a package is held by customs due to prohibited items.
Please note that intimate toys or 'Poppers' are not allowed in some non-EU countries.
E. Order tracking.
Once your order has been shipped, we will send you a tracking confirmation to the email address you provided with your order. This email will contain your tracking number which you can use to track your package and ensure correct delivery. You can also find tracking information for your order on the 'My Orders' page of our Website. Please allow 24 hours (Monday to Friday, excluding holidays) for tracking information to be updated on the carrier's website.
7. Cancellations
To the fullest extent permitted by applicable law, we reserve the right to refuse or cancel any order for any reason, including limitations on available quantities, eligibility requirements, inaccuracies or errors in pricing information, or issues identified by our credit and fraud prevention partners. We are not responsible for pricing, typographical or other errors. We reserve the right to cancel any orders resulting from such errors, even after receipt of an order confirmation. If we cancel your order after charging your credit card (or other payment account), we will credit the amount charged back to your account. Edenlov may, at its discretion and to the extent permitted by applicable law, either contact you for instructions or cancel your order and notify you of such cancellation. If a product purchased from us is not as described, you may return it and receive a credit for the purchase price, subject to our return policy described in Section 8 below.
8. Returns
If for any reason you are not satisfied with your purchase, you have 30 days from the date of receipt to request an exchange or refund. The item must be returned to us undamaged, unused, and in its original packaging. To do so, please fill out the contact form provided on our Website. Please note that we reserve the right to refuse any return requests at our sole discretion. If your return request is accepted, we will issue and email you a return slip with instructions. Please pack your item(s) according to these instructions, including the return slip, and send them to the address provided. Unless otherwise stated in the Additional Terms, you are responsible for the cost of return shipping. Please ensure that you request a tracking number and obtain packaging insurance from your carrier. If the item received does not meet the return conditions, we reserve the right to refuse it and return it to you at your expense.
If a refund is requested: The refund credit will generally appear in your account within 5 to 7 days (Monday to Friday excluding public holidays) from the date the returned item arrives in our warehouse. We will credit the original credit/debit card used to place your order. If the purchase was made using PayPal, the refund will be issued to the credit/debit card used through PayPal. Please note that a refund request does not include a refund of the original shipping costs.
For exchange requests, we will ship the new item to you within 2 to 3 days (Monday to Friday, excluding public holidays) after receiving the returned item in our warehouse.
9. Promotions
We may offer promotions that include additional terms and conditions that may apply to your order. Please carefully read the additional promotional terms and conditions. In case of any conflict between the Additional Promotional Terms and these General Terms and Conditions, these General Terms and Conditions shall prevail.
10. Settlement of disputes
This section may only be modified through mutual agreement. In case of any dispute related to the Website, Content, these Terms, or any Additional Terms, you and we agree to exchange notices with a clear description of the dispute and a proposed resolution. The notice will be sent to you using the most recent contact information you have provided. If such information does not exist or is not current, we will not be obligated under Section 10(A). For a period of sixty (60) days after receiving the other party's notice, you and Edenlov will engage in dialogue to attempt to resolve the dispute. However, neither you nor Edenlov will be obligated to resolve the dispute in this context.
These General Terms and Conditions of Sale are governed by French law. If an amicable settlement cannot be reached, the dispute shall be submitted to the jurisdiction of a French court
11. Disclaimers and Warranties
A. Product Disclaimers.
Tips, FAQs, suggestions, or other recommendations regarding the handling and care of certain products or items (e.g., intimate toys, intimate clothing, wellness products) may be posted on the Website. These statements do not guarantee how any product or item will perform, last or satisfy. Any such advice constitutes a recommendation only.
B. Warranty.
If your item has a manufacturing defect, we will replace it or refund you in accordance with section 8, depending on your decision. If the item is no longer available, we will either replace it with an item of equal value of your choice or provide a refund, whichever you prefer.
12. Privacy
We are committed to protecting your privacy and will process all personal information collected from you in connection with your purchase of orders through the Website in accordance with our Privacy Policy.
13. Applicable law and jurisdiction
This Website operates from France. Any matters arising from or relating to orders or these General Terms and Conditions of Sale shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions, the laws of any other jurisdiction do not apply.
